JetBlue hit with lawsuit after passenger suffered ‘tooth fracture’ from ice cream sandwich

A JetBlue passenger filed a complaint this week alleging she was served a “frozen solid” ice cream product that fractured her tooth during a flight.
Kiara Quinonez is alleging the airline served her a strawberry shortcake ice cream sandwich that led her to sustain an oral injury, according to documents filed Oct. 22 obtained by PEOPLE.
The complaint filed in New York Eastern District Court accuses the airline of serving “food at a temperature below what is reasonable or safe for consumption” and did not “warn [her] of the dangerously cold temperature and solid state of the ice cream sandwich she was served.”
Quinonez’s lawyer and JetBlue both did not immediately respond to request for comment.
The “chomp size” ice cream sandwich was provided to Quinonez while on a flight from John F. Kennedy International Airport in New York City to Charles de Gaulle Airport in Paris on Aug. 20.
She claims the dessert was “frozen solid,” which led her to “sustain severe bodily injuries, including a root fracture of tooth number 10,” also known as the upper left lateral incisor.
She claims she had to get an emergency tooth extraction, a later implant and additional care as a result of the injury.
The lawsuit alleges the airline’s “negligent acts” led to her “pain, suffering, and mental anguish.”

“As a direct and proximate result of the acts of Defendant, its agents and/or servants as aforedescribed, Plaintiff sustained severe and permanent bodily injuries, suffered pain, suffering and mental anguish, and incurred expenses for medical care and treatment, all of which are continuing,” the complaint alleges.
According to the complaint, she is demanding judgement “in a sum to be determined by a jury at the trial of this action” as well as interest and other “relief” that the court “may deem just and proper” from the airline.
